For the purposes of these Terms & Conditions, Tolerantdiversity, Lda. is referred to as "JOVI".

2. Scope

These Terms & Conditions govern access to and use of the JOVI website, purchases made through the JOVI online store and the contractual relationship between JOVI and its customers.

Where the buyer is a natural person acting for purposes outside their trade, business, craft or profession, they are treated as a consumer and benefit from all mandatory rights provided by applicable Portuguese and European Union law.

Nothing in these Terms & Conditions is intended to exclude or restrict mandatory consumer rights.

3. JOVI products and kits

Each product or kit page describes its essential characteristics, composition, quantity, price and other information relevant to the purchasing decision.

The composition applicable to each purchase is the composition displayed on the product page at the time the order is placed.

JOVI kits may contain products from different manufacturers and categories, including items relating to protection, safety, hygiene, organisation, first-aid support and preparedness.

Photographs and illustrations aim to represent products as accurately as possible. Manufacturers may introduce changes to packaging, presentation, design or other non-essential elements provided that the contracted essential characteristics are not materially altered.

4. Product safety

Products must be used in accordance with their intended purpose, instructions, limitations, storage conditions, warnings and expiry date, where applicable.

Where legally required, the online offer will make available the relevant safety and traceability information, including, as applicable, the manufacturer, contact details, the responsible person established in the European Union, product identification and relevant warnings or safety information.

Where an item is personal protective equipment, a medical device or another product subject to sector-specific legislation, the legal requirements applicable to that category also apply.

Including a product in a JOVI kit does not change the purpose, classification, certification, category or level of protection assigned by its manufacturer.

JOVI does not attribute characteristics, certifications or protection levels that differ from those supported by the manufacturer's information and documentation.

5. Appropriate use

JOVI kits are intended to provide organisation, convenience and access to products suited to the purpose described for each kit.

They do not replace, where required, medical assistance, emergency services, professional advice, a specific risk assessment, specialist training or professional equipment appropriate to a particular activity or hazard.

This clause does not exclude or limit any liability that cannot lawfully be excluded or limited.

6. Availability

All orders are subject to product availability.

If a product becomes unavailable after an order has been placed and the order cannot be fulfilled, JOVI will inform the customer as soon as reasonably possible. Amounts paid for the affected product or order will be refunded where appropriate, without prejudice to any other rights provided by law.

7. Prices

Prices displayed to consumers include VAT and other taxes legally applicable, unless the law permits or requires a different presentation.

Before the order is completed, the customer will be shown the price of the products, applicable taxes, delivery charges, other applicable charges and the total amount payable.

No additional charge will be imposed unless it has been disclosed before the customer places the order.

8. Promotions and price reductions

Promotions, discounts, promotional codes and other price reductions are subject to the specific conditions announced for each campaign.

Where a price reduction is advertised, JOVI will comply with applicable rules concerning the indication of the prior price and other mandatory consumer information.

Whether promotions or promotional codes may be combined depends on the conditions expressly stated for the relevant campaign.

9. Ordering process

Before completing a purchase, the customer can review the selected products, quantities, price, delivery costs and total amount and can correct any input errors.

The customer will also have access to these Terms & Conditions and to information about the right of withdrawal before the order is completed.

The final ordering action must make it clear that placing the order entails an obligation to pay.

After the order is placed, confirmation will be sent to the email address provided by the customer or through another appropriate durable medium.

10. Payment

Available payment methods are displayed during checkout. Payment processing may be provided by independent payment service providers, including Stripe where enabled.

Where full card or payment instrument details are entered directly within the payment provider's environment, JOVI does not receive or store those complete details.

An order may be conditional on confirmation of payment.

11. Invoicing

Invoices are issued using the details supplied by the customer and in accordance with applicable tax law. The customer should check billing information before completing the order.

12. Delivery

Available destinations, delivery methods, costs and estimated delivery times are displayed during the ordering process.

Where no different delivery period has been agreed, the period required by applicable law applies.

For consumer contracts, the risk of loss or damage passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods, subject to any statutory exceptions.

13. Failed deliveries

The customer is responsible for providing a complete and accurate delivery address and, within reason, making delivery possible.

If an order is returned because of an incorrect or incomplete address, unjustified refusal or another delivery failure attributable to the recipient, JOVI may contact the customer to arrange a new shipment. A new shipment may be subject to the actual additional transport costs where permitted by law.

14. Checking your order

Customers are encouraged to check the order after delivery. If the transport packaging shows visible damage, it is advisable to photograph the packaging and affected products and contact info@jovi.com.

This recommendation is intended to facilitate resolution and is not a condition for exercising statutory rights.

15. Right of withdrawal

For distance contracts, consumers generally have 14 days to withdraw from the contract without giving a reason.

For purchases of goods, the period generally starts on the day the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.

The procedure, consequences and statutory exceptions are explained in the Delivery & Returns Policy.

16. Sealed goods for health or hygiene reasons

JOVI does not apply a blanket rule excluding returns merely because a product relates to hygiene, health, safety or protection.

The statutory exception to the right of withdrawal will only be relied upon where the legal requirements are met, including where:

• the product was supplied genuinely sealed;
• the seal objectively serves a health or hygiene protection purpose;
• the goods are not suitable for return for those reasons once unsealed; and
• the consumer removed or broke that seal after delivery.

Opening the transport packaging or the outer box of a JOVI kit does not, by itself, remove the right of withdrawal.

17. Partially opened kits

If a kit includes products individually sealed for health or hygiene reasons, consumers are advised not to open those seals while deciding whether to keep the order.

If only one or some components have been opened, the situation will be assessed having regard to the nature of the item, the existence and purpose of any seal, whether components are separable, the condition of the remaining goods, any use of the goods, any reduction in value and applicable mandatory law.

JOVI will not automatically refuse the return of an entire kit merely because its outer box has been opened.

18. Inspection and reduction in value

A consumer may handle and inspect goods to the extent necessary to establish their nature, characteristics and functioning.

If handling goes beyond what is necessary for that purpose and reduces the value of the goods, the consumer may be responsible for that reduction in value in accordance with applicable law.

19. Personalised goods

The right of withdrawal may not apply to goods made to the consumer's specifications or clearly personalised. Where JOVI sells a product covered by this exception, that information will be provided before the purchase is completed.

20. Legal guarantee of conformity

Products sold by JOVI to consumers benefit from the statutory conformity regime.

Under Portuguese law currently applicable to new movable goods, JOVI is liable for a lack of conformity that becomes apparent within three years from delivery.

A lack of conformity becoming apparent during the first two years benefits from the statutory presumption concerning its existence at the time of delivery, except where this would be incompatible with the nature of the goods or the lack of conformity.

Depending on the applicable legal requirements and circumstances, remedies may include repair, replacement, a proportionate price reduction or termination of the contract.

21. Lack of conformity within the first 30 days

Where a lack of conformity becomes apparent within 30 days after delivery, the consumer may, in accordance with applicable Portuguese law, request immediate replacement of the goods or termination of the contract.

22. Withdrawal and conformity rights are different

The right of withdrawal and rights arising from a lack of conformity are separate legal regimes.

A valid exception to the right of withdrawal for a health- or hygiene-sealed item does not remove the consumer's statutory rights if the product is defective, unsafe or otherwise non-conforming.

23. Liability

JOVI is responsible, in accordance with applicable law, for the conformity and safety of the products it supplies and for the obligations imposed on it as a trader.

To the extent permitted by law, JOVI is not responsible for damage caused exclusively by use that is manifestly contrary to the product's intended purpose, instructions or safety warnings.

Nothing in these Terms & Conditions excludes or limits liability that cannot lawfully be excluded or limited.

24. Intellectual property

The JOVI brand and the website's original content, including texts, guides, manuals, visual identity, graphics, photographs, videos and design, are protected by applicable intellectual property law.

Reproduction, modification, distribution or commercial exploitation without permission is prohibited except where permitted by law.

Trademarks, images, instructions and other materials belonging to manufacturers or third parties remain the property of their respective owners.

25. Personal data

Personal data processed through JOVI is handled in accordance with the Privacy Policy and, where relevant, the Cookie Policy.

26. Complaints Book

JOVI provides consumers with access to the Portuguese Electronic Complaints Book (Livro de Reclamações Eletrónico) as required by law. A link to the official platform should remain clearly accessible on the website.

27. Alternative Dispute Resolution

In the event of a consumer dispute, the consumer may use a legally competent consumer Alternative Dispute Resolution body.

Given the location of Tolerantdiversity, Lda., the following body may, in particular, be competent:

This does not prejudice the competence of another ADR body under the law applicable to the particular dispute.

29. Governing law

Contracts concluded through JOVI are governed by Portuguese law.

Where the customer is a consumer habitually resident in another European Union Member State and the relevant legal conditions are met, this choice of law does not deprive the consumer of the protection afforded by mandatory provisions of the law that would otherwise apply.

30. Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions remain unaffected to the extent legally possible.

31. Changes

JOVI may amend these Terms & Conditions to reflect legislative, regulatory, commercial, technical or operational changes. Each order is governed by the version in force when the order is completed.
